Welders in CA, CO, OR, WA, etc (medical marijuana states)

If you are a welder in one of the 15 or 16 states that allows medical marijuana, can your company fire you for testing positive? I have a stomach condition that I used to take medicine for, but dont anymore due to high cost and the horrible side effects I experienced (acid reflux, ibs, suicidal thoughts, etc). I started smoking pot once a day, usually in tge evening a few hours before bed because for whatever reason it flares up then. I have no side effects, I can eat fine and my doctor has told me that, mentally, I am better off. But I am in florida and $10 worth of pot will get you arrested and of course fired from a job. I know its a touchy subject, but do they fire people out west for doctor prescribed medical marijuana cards?  I suffer from the same conditon kurt cobain had, and he turned to heroin and eventually suicide, both of which are obviously out of the question.Read my welding blog:http://weldeveryday.wordpress.com/
Reply:Around here you'd find that maybe 25% of the small shops would be okay with you smoking after the work is done, probably on a don't ask, don't tell, type basis. When I say small, I mean 5 people or less. Anything bigger, and 100% will have policies. That's the business side, insurance, lawyers, etc. On the personal side, my guess would be about 50% of shops would have someone wanting to pass one around.Ian TannerKawasaki KX450 and many other fine tools
Reply:They have lawyers that specialise in employment law.  I'll give you one example.  If you are legally using a drug and become addicted to it, you may be covered under the ADA.  That is one reason employers try to screen out as much as possible before you are hired.  After you are hired (depending on all kinds of laws) you may be protected.However, most places allow employers to fire for any other reason.... they don't like the shirt you are wearing....I'm sorry about your medical condition, but perhaps you can get the THC or whatever it is that helps you from a legal source (with prescription if necessary).  That of course would be the best solution.As for your stomach issues, I would also consider talking to a doctor about nutrition, food choices and eating habits.   You might find ways to control your pain that way as well.  My wife picked up a bad habit from her mother of 'popping' an ant-acid after every meal.  Screwed up her stomach to the point that I don't think she even knew what feeling 'normal' meant.  It took a while to break that.My biggest peeve with doctors is their solution to everything seems to be a prescription for some medicine.  Every medicine has side affects, some even slowly kill you (statins).  I would prefer a discussion with a doctor over dietary and exercise changes first, lifelong prescription as option 2.Con Fuse!Miller Dynasty 350Millermatic 350P-Spoolmatic 30AMiller Multimatic 200Hypertherm PowerMax 1000G3Miller Maxstar 200DX

Reply:Recently worked in a dairy precessing plant for fairly long term project in a state that had the med.maryjane card. Developed a few friendship with a couple mechanics and such within the plant.Couple had mentioned how they had the "card" for bad backs and such. One day a whole lot of people where missing from the plant.Pulled a random drug test in the facility. I guess when they signed on, the company had a "no drug policy" for insurance liability reasons......cut and dry. Needless to say they were gone.I for one think a guy can do whatever he wants to after work. But, when the man makes the rules and is sighning your check....you better live by his rules or your out.I'm sorry about your situation and feel you should be allowed to use for medical resons. From my experience (what I witnessed) the company has no way of determining legit claims from bogus ones. To most companies (and their insurance company) they  want nobody working under the influence of anything for liability reasons. You can be dumb as a bag of rocks that's ok. Just don't take a hit and know your sh*t or your gone.
Reply:When I had multiple semi trucks, I told my guys that I didn't care what they did on the weekend. As long as they didn't come to work hung over or high, I figured it was none of my business. But then, I thought if one of them were to get into an accident and get tested on the spot, then pissed hot, it would all be on me. Reply:Indiana doesn't have the medical MJ law. At our company, and I'm sure it is similar with other contractors, if you get injured on the job and seek medical help under worker's comp., you have to give a sample right then and there in ER or where ever. We have let guys go in the past that come back positive. Just last year, I had my little finger on RH get smashed (just missed the last knuckle), literally exploded on the job. Went to ER, was in a lot of pain sitting in the exam room waiting for the doctor and I passed out. After I came to, a nurse gave me 2 pills and drink of water. Turned out they were pain killers(forget which ones). Then I realized I had to give a sample. I figured that there was no way they would show up on the drug screen and the nurse said she would make sure that she noted I was given these. Turned out oK but I did tell my boss about it.  It's the insurance requirements that drive this.
Reply:It depends on the employer & or union.In the NE Carp union you cannot operate any power tools or equipment while under the influence of any drug.  Prescribed or not. Piss dirty & your down the road for pot.  Even perks, to the utter dismay of my pill happy buddy Jeffbomb..Of course all of the junkies & Crackheads are entitled to union based rehab, because they are just so damn heal-able..  (& a steward's kid...)Buy American, or don't whine when you end up on the bread line.

Reply:In the past, long ago, I have denied workmans comp. No test, no problem. If you already have insurance, a few stitches here and there is no big deal. Its when you break your back you stand to loose big time. Now I got kids, so I wont take the risk.
Reply:Yes, employers have the right to fire you. I have heard many cases here involving it. Reply:On a somewhat related note, (I am a non smoker) people here aren't just getting high everyday, all day, like it might portray to the rest of the states. Police Officers have handed out tickets to people smoking on the side of the road, parks, and in general the public, even though these people have licenses. It is treated like alcohol. Drunk in public, ect. who knows if the charges stick or are prosecuted is another thing, but some officers ARE taking a stance against it. My tenants that are from Kansas (Wichita) also stated that if you have an MMJ card, that you are no longer allowed to vote.
