Gadget I came up with

Now I know this is not as complex as some things everyone else has done.  It is a little thing that came about out of necessity.  By the way, Zapster update us on your patented plow lock!  Winter is coming.Here is the story, I had to go get 2 propane tanks for the forklift with a pickup.  Well I bungeed them and took off. Within a mile they were rolling around.  I stopped 3 times in the 9 mile trip to try to secure them.   I have also had to get welding tanks and torch tanks with a pickup too, it sucked.Any way after some trial and error I came up with this aluminum bracket and strap that clamps to the rail of a truck bed.  It is simple, and works quick to hold tanks up.  Here is a picture of one I made by hand, and the link to the web page that sells them now.  http://www.overtimeequipment.com/ser...tote%2C/DetailThe finished ones look different, powder coated and laser cut.  Anyone one interested in ordering one can use my discount code -  hotweld to get $5 off.Maybe, I hope, they will be available at your local welding supply shops in the future!  A man can dream can't he. Reply:trust me...douglass dynamics wants something from me..my boss and monarch machine..and i'm not signing anything untill the patten lawyers we have look at this too...this is bigi dont care what anyone has to say...there is no reason in the world why they would have sent me a form to signwhen i'm a nobody except i have the patten pending on this concept...think about itwhy would they?come up with any reason you want...something big is brewing here..and thats that...zap!I am not completely insane..Some parts are missing Professional Driver on a closed course....Do not attempt.Just because I'm a  dumbass don't mean that you can be too.So DON'T try any of this **** l do at home.

Reply:I don't think harv is talking about zap's lock, but about colemg01's thingie.  I think there IS something to consider here.  Be careful what you publish about your ideas if you intend to go for a patent.  Items in the public domain are not patentable.  I would hate for anyone to miss out on their big chance because of little thing like posting/publicizing before obtaining a patent pending status and letting a good idea either slip away or into someone elses hands.  I am not a patent lawyer or expert in any way, but if it's really a good idea, I would err on the side of caution...Here is a little exerpt from a wikipedia search on the patent process that might provide a bit of info:With regards to patents, on the other hand, public use or publishing the details of an invention before applying for a patent will generally place an invention in the public domain and (in theory) prevent its subsequent patenting by anyone –- in U.S. (not European) law, an inventor may file a patent claim up to one year after publishing a description (but not, of course, if someone else published or used it first).Not difinitive, but....Last edited by smithboy; 08-22-2006 at 10:02 AM.Smithboy...if it ain't broke, you ain't tryin'.

Reply:Hello all, I am new here and this is my first post.I enjoy reading the patent posts on every forum I can find. I have three patents for tools I created for companies I worked for. They are the licensee and paid me for the invention (not much either). Every one of them took 3+ years to get granted. Every one of them was challenged and the legal eagles had to prove various claims.  By sharing the idea prior to filing for the patent or by filing a provisional patent application you give up all right to foreign patent rights. This is important if your item has the potential to sell worldwide. Two of my three are patented in over 100 countries, only because the company worked in all those countries and they wanted to be sure to cover their backsides.Remember, if you are looking to license out your product to someone else (like the propane bottle holder) you can negotiate a percentage of sales of which I am sure you know BUT if they offer you a lump sum buyout to sign the entire thing over you know you have a winner, make sure you get a good paycheck for that.Some companies will buy you out and never produce the product just to keep it from competing with another product of theirs so be sure to put something in the contract that states if it is not produced in "X" amount of time, you get the rights back or more cash.You may want to charge more if you license to this company ONLY. If you can have several companies make it, you can potentially make more cash so if they lock you in to them only, hold out your hand.Just my unsolicited .02
