oxygen/ actylene bottles

I got stopped the other day and they said i need to have my bottles stored in the upright position is there a law about that or what the deal i see rig all over with them laying across the bed my acetylene is in up right and oxygen laying down

Reply:Ive never heard of that law. If they were laying down in your truck, howd the cop even see them?Acetylene SHOULD be transported upright just to keep the acetone in the bottom of the tank, but if it gets sideways, all it takes is an overnight right side up and its good to go again.[Account Abandoned 8/8/16 Please Do Not Attempt Contact Or Expect A Reply]. Reply:there mounted in front of my welder on a welding bed and i know the acetylene needs to be mounted up and thats how it is on my rig he said all bottles are to be mounted upright it was a bexar county sheriff out by san antonio tx
Reply:I haven't heard of that one before. We roll all over Texas with our oxygen bottles laying down. Maybe the officer that told you that is confused.
Reply:I've never heard of it and my rig has the oxy bottle laying down and has been that way for 30 years now.
Reply:Correct me if I'm wrong but according to D.O.T. regulations the bottles must have caps on and secured so they cannot be ejected from vehicle.Shake and Bake
Reply:yea i pull my gauges off because a while back i had one get stolen and i have 1/4 inch plate with locks to keep them from moving back and forth ill get a pic up of the truck
Reply:When I say ejected I mean if you was to roll over your truck, they would for lack of a better term flop out. As compared to had a head on with a 737 be ejected out.Shake and Bake
Reply:I think you will be ok, the way it is here you can go talk talk to judge or county prosecuter and argue the case ( if you are within D.O.T. regulations ). If not then pay the ticket. Speaking from experience don't argue with the law unless you want to go to jail.Shake and Bake

Reply:Though not a legal opinion, the LWS may be a good first place to check. If they give you the macho"phuk them" response or to cut to the chase, call DOT. The cop wasn't busting you for an un / inadequately secured tank was he? IMHO just chaining it down to the bed ain't enough. head on or rear end impact could make it a torpedo. A cradle with end caps would be best. I don't think upright, just chained/strapped in has any advantages over flat.  You mileage may vary.......PS:  If he didn't speak specifically of what was incorrect, as in "you should have it this way and that, not like this...." , then I'd say he saw something that looked dangerous that he didn't understand and decided have a go with you. DOT, they'll know. And get it in writing and keep it in your glove box with your vehicle papers for next time. Just present it in a gentle manner as to not poke the bear. Reply:I've heard reference to a law requiring all cylinders to be vertical maybe half a dozen times.  When I asked where it came from, I never got a clear answer.  Some people said USDOT, some people said state DOT, some people said OSHA / MSHA, some people said....There is a fair amount of 'gossip' about this out there.  I would like to hear a good 'yes' or 'no' and a definite source cited.
Reply:I have never heard they all must be upright, caps yes. The tunnels are strict around here & hapton roads. However I can tell you how many scrap guys I see riding around Richmond with them ratchet strapped on the top of the load, or sticking out of a trailer, truck bed, trunk, window, etc. The list for that can go on and on...You have to learn the rules of the game. Reply:Find the regulations, print two copies, carry the with you, hand one copy to cops.I recall a thread where a HazMat transporter of some experience did so. How-ever, after December 31, 2003, a pressure relief device, when installed, mustbe in communication with the vapor space of a cylinder containing a Division 2.1 (flammable gas) material.
Reply:Your lucky you just got a warning they are known chicken poop tickets.  The eastern city limits of San Antonio is miles east of the actual city but the speed limit changes on i10 there.  They use sit out there and give lots of tickets.  You can guess how I know this.

I believe what's being referred to is the fact the OSHA has a regulation that states...1926.350(a)(9)Compressed gas cylinders shall be secured in an upright position at all times except, if necessary, for short periods of time while cylinders are actually being hoisted or carried.
Reply:cops screw up all the time, some aren't smart enough to tie their shoes; or  maybe you looked dirty and he needed a reason to pull you over and have a look,  see if you had anything on the floor so he could invoke the 'plain view doctrine'.   or do you think they only profile blacks?did he go through the truck?

If your vehicle doesn’t have racks to hold cylinders,the cargo space floor must be flat. The cylinders must be:Held upright or braced laying down flat.In racks attached to the vehicle.In boxes that will keep them from turning over.
Reply:no he didnt go threw the truck he was manly looking on the bed for stuff not tied down i guess he walked all around the back two or three times but there nothing not tied down or locked up back there. Thanks everyone i have mine locked up so they dont go mia on me where i live so i should be good then. I really think he was trying to find something wrong a few other guys i know have had there welding rigs stopped by the same cop and he forgot to say he dipped my tank for red diesel i think he trying to be DOT hero
Reply:so the clown pulled you over because you allegedly had an improperly loaded cylinder.  he walks around your vehicle a few times implying that a crime may have been committed,  and then the Ahole conducts a warrantless search of your vehicle; ie dipping the tank.this was the reason he pulled you over in the first place;  otherwise you would have been cited.   it's done every day.   if he's so worried you avoided a fuel tax  why doesn't he get a job with the DOR.   the day is coming when they'll come and go as they please.Interesting the use of the phrase," ...short period of time". That pretty much makes it useless and open to situational interpretation.
