I ordered a new Milwaukee Dry Cut Saw off of Ebay.  UPS delivered it yesterday.  They smashed it!The box looked fine, so I didn't open it right away.  When I did, I found the casting that holds the pivot shaft broken in half.I used to fly charters for a living and I remember watching the UPS guys unloading their plane every morning.  They would drop large items to the pavement, about 6 - 8 feet!  Guess that's what they did to mine.I've been in contact with the seller, and I'm sure we'll get it worked out, but I was planning to use it today...America Needs AMERICA'S Oil!!!"Global warming is the greatest scam in history ...There is no run away climate change. Reply:There are some  masters at denying freight damage claims. Let us know how it turns out.
Reply:Ya know the old saying " Better pissed off than pissed on" Hope you dont get both......
Reply:Anytime you do not directly pay for shipping, the party that does must be the one to file a claim.  In your situation, THEY paid UPS.  Now, in order to file a claim, UPS will probably want to come get the saw, leaving you with no saw and no money.  You will then be at the mercy of the seller to send you another one.Next time, if the packaging is damaged in any way, check the internals BEFORE signing.  If it's damaged, do not accept it.
Reply:About two years ago when I bought my Lincoln SP175 plus from an eBay listing, it came totally smashed. It had the entire plastic front face driven back approximately 6 inches into the case. Nice, huh?The problem was partly that the company that shipped the unit did not pack it properly. They used the retail sales carton and just put a UPS sticker on it. The other part of the problem was the typical UPS handling which can only be described as "lusty". So the inevitable happened.I got on the telephone to the seller, which is a Lincoln dealer in Indiana and they gave me the number for the Lincoln Depot in California where I am. I'm northern California and the depot is in Soothern California. All the Lincoln Representative asked for was some pictures of the damage that could be e-mailed to them which I promptly sent. They immediately approved another machine and they sent it to me  by private freight carrier. The new one was double-packed and I simply exchanged the broken one for the new one. All of this happened in the short space of three days! I have to say that Lincoln went out of their way to help me out because I guess they could have just thrown me under the bus and left me to work my problem out with UPS. Good old UPS. Getting your shipments to you on time all the time with all of the broken and smashed parts in the same box!Good luck on getting a replacement!
Reply:this doesn't relate to welding but sense we are talking about our friends ups,at work we ordered in a crankshaft, for what i don't remember, anyway it weighed over 70 pounds, had a big orange sticker with its weight and everything, the man from ups carries it in puts it on the counter and wants a signature.we told him we aren't accepting it, with a confused look he asked why??? we asked him if it feels alittle light for that sticker on it? he said well yah it does, we told him probably because the end of the box is missing and it is empty!!!!!  all he said was ohmakes me wonder what there hiring requirements are?I wonder if I will be spanked for this one too!?!
Reply:Engloid is spot on.  I ordered 50 computer cases once, they came in smashed and dented.  Sender had my money, I called him he filed a claim.  They came (UPS) to pick them up, sender never send a new shipment to me.  I was out the broken product and the money. He probably was refused.  So UPS and the sender were moron.  Hope you do not end up in that loop.Major hit to the bottom line for sure.Good luck on the replacement.  Keep all the papers, since it is a name brand you can call the company like gnm109 did and they might help you out.
Reply:I talked to the seller yesterday.  He will make it right somehow, but he's reluctant to send another saw because it will likely get broken, too.  He is leaning toward refunding my money.  I'm hoping that we can just get a replacement casting from Milwaukee, or perhaps he can disassemble another saw and ship it in two boxes, or something like that.UPS does not pay damage claims.  Period.  The seller told me that this is the 5th damage claim he's had with UPS in about 8500 shipments.  He said that last year alone, he paid $45,000 in insurance with UPS, yet they refused two claims he had totalling less than $1000.The company I used to work for averaged $7000 in damage every month with those bastards!  They're terrible, especially the people that work at this office.I've had other damage claims in the past and the shipper always ate it.  I had a friend that sent his airplane propeller off for overhaul.  It was delivered with a tire track across it!America Needs AMERICA'S Oil!!!"Global warming is the greatest scam in history ...There is no run away climate change. Reply:My last UPS transaction (and I do mean last) was a 2-Day letter pack that arrived in three days, apparently because the driver didn't feel like stopping and emptying the drop-box on Friday afternoon.  They wouldn't even knock some money off the cost and I'm still waiting for a supervisor to call me back after they "investigated" the incident.  Previously their local driver logged that a package was delivered to my house at the back door, but I could not find it.  After canvassing the neighbors to see if they had it, I notified the sender who agreed to file a loss claim the next day.  Darned if it didn't get delivered the next day.TeddCoHTP Microcut 400 & Invertig 160DC  Smith Dual Guard MD-510 OA Rig  Lincoln SP135+  Hobart Stickmate LX 235/160

Reply:The saw was shipped in the original Milwaukee shipping carton, with egg crate cardboard inside the box.  The box meets UPS requirements.  The seller misspoke on the insurance amount, the $45K was his total UPS bill, not just insurance.GOOD NEWS!!!  The seller contacted Milwaukee and they are going to drop ship a replacement casting to me!Oh, yea, the seller is m3nuts.  If you want to deal with an honest Ebay seller, he's a good one!America Needs AMERICA'S Oil!!!"Global warming is the greatest scam in history ...There is no run away climate change. Reply:Well, I'm Canadian, and won't deal with any American company, or individual that won't send via the USPS/Canada Post.   Simple reason is that courier companies ding us Canadians big time in what they call "brokerage fees".   Often times they charge up to 1/3 the price of the original item for this fee IN ADDITION to the shipping!  There is actually a class action suit in front of the British Columbia Supreme Court about this.  USPS/Canada Post also charges brokerage, but it is either $5 or $10, can't remember which.
Reply:Last winter, I was having a rare piece of auto side trim shipped to me.I paid the shipper extra to buy new PVC plumbing pipe and correct caps to use as a shipping tube. The tube arrived smashed. You folks know how tough PVC pipe is; it almost seems like it had to be a deliberate act, to figure out how to smash the tube and contents.

Reply:Yes, I'm aware of that, that's why I tell the seller up front why it has to go USPS, due to exhorbitant fees and make it clear that it goes that way, or I won't deal with them.... Originally Posted by EngloidDo keep in mind that when we (in the US) ship something to Canada via UPS, they don't tell us anything about the fees you will have to pay on your end.  We are left to assume that when we ship the item, all costs are covered, except for maybe your taxes.  UPS does NOT tell us that they act as their own broker, and absolutely rape the Canadians for it.I once shipped a rear end differential to Canada.  The value of it was $400.  It was $130 for shipping.  When it got there, the buyer had to pay something like $170 to get it.  Essentially, they hold the item hostage on that end and the buyer can't have the item unless they pay the randsom.  Further, in my particular case, the Canadian guy didn't really know what was going on either.  He was under the impression that I had sent it collect, after he had paid me for the shipping cost.  He was very upset with me until he figured out that UPS was to blame.
Reply:Yes, I hear you and can imagine it can be a pain in the butt for a seller.   However, the days of UPS and other couriers doing it *might* soon be over.    There are several lawsuits, some of which are class actions, that just might resolve it.  Here is a link to one of them:http://www.classaction.ca/content/actions/ups.aspIn any case, for me as a consumer it's simple.   Either ship it via USPS or don't ship it at all, and I make this clear with every transaction....Like the grill story!   Originally Posted by DSWIf you all think UPS is bad, the USPS is worse if things do not arive as planned. I used to work part time in a business that did about 65% of the sales as mail order. Some items had to be shipped USPS. FPO's, some forigien shipments, PO boxes and so on. All items insured and return recipts required. When the item didn't show you could file a claim. They would wait 6 months to be sure the item was not lost in transit before begining the refund process. Tracking a package was a royal PITA. We avoided USPS like the plauge. Pain to take it to the postoffice, stand in line, fill out what ever new forms were required (and there are different forms for customs on big boxes vs small boxes, different forms for overseas packages vs PO boxes, diferent forms for return reciepts, various methods of shipping and prices depending on where the package is going. ) A postal trip usually lasted 2-3 hours to ship 2-5 packages.I do agree about the extra charges UPS puts on forgien packages. We had several problems with the extra fees and as said UPS doesn't tell the shipper what these will be even when you call for a quote for shipping. I also agree that they do everything they can to aviod paying out on claims. We would get the damaged items back form the customers, hopefully with the original shipping packing complete and then hold them for UPS to look at it at their convienience. I lost quite a bit of money myself on things that I shipped from the shop to buyers on personal sales. UPS would destroy them and then claim that the items were packaged wrong. Items frequently got delived to the wrong addresses and the tracking info didn't always match what actually happened.I do have a friend that drives for UPS. The first week on the job he delived a package to a customer. It's pouring down rain and there is no great place by the door to leave the package, so he puts it in the grill and leaves a note on the door saying where the package was placed. You guessed it. Home owner comes home and the note is missing, ignored or soaked, and fires up the grill with out opening the lid. So, how well done do you like your shipment? 3rd degree or charcoal?  He'll never do that again!

Reply:i have that same saw, they work great
Reply:"found the casting that holds the pivot shaft broken in half"---------------------------------------I bought one off of Ebay. It came, UPS, the handle was broken off. I told the seller and contacted Milwaukee thru the website.   (Is yours refurbished...meaning you get the full five year guarantee?)Next day, I got two emails. The seller had contacted Milwuakee and Milwaukee got my email and responded.  I was getting two new, not just handles, but the whole assembly...for free.  The Seller was great and Milwaukee was great.  Don't know if we have same seller, but write to Milwaukee and tell them the exact circumstances.
Reply:who was the seller
Reply:I received my replacement casting from Milwaukee yesterday, tried the saw last night. The saw was new, not refurbished.  Milwaukee sent the part at no charge to me or the seller.  Seller was m3nuts.America Needs AMERICA'S Oil!!!"Global warming is the greatest scam in history ...There is no run away climate change. Reply:When I spent a summer building pumps, we used to have to put the pumps in larger than normal boxes when a customer ordered it to be shipped UPS, this would give us some extra crush room when the package was, not if, mishandled.
